Welcome to Bella Bohemian LLC (“Bella Bohemian,” “we,” “us,” “our”), a wife-and-husband shop operating from Fairfax, Virginia. These Terms govern your use of bellabohemian.com, any order you place, and any signup for our email list. By using the site, placing an order, or joining the list you agree to them. If you do not, leave the site and do not subscribe. Please also read our Privacy Policy, Shipping page, and Returns page; they work together with these Terms.
Age
You must be 18 or older to use this site, to place an order, or to join the email list. We deal only with persons of legal age. There is no parent-or-guardian exception for a buyer or a subscriber under 18. We do not run an identity check on a signup. We cannot screen every motive. The list is still an adult list.
The site is not directed at children. No one under 13 may submit personal information. If we have reason to believe a person under 18 has used the site, placed an order, or joined the list, we will not keep doing business with that person. We will remove that address from the newsletter. An order that has not shipped will be cancelled and refunded to the payment method used. An order that has already been delivered stays with the recipient unless they demand the money back. If a refund is required by law, the goods must come back first — unused, undamaged, and in original condition, in the original packaging with original tags — at the buyer’s expense for insured tracked return shipping. A sealed box that was crushed on the way back is not original condition. Damage in return transit is on the buyer. A 30% restocking fee applies to the same extent as on our Returns page, except where the law requires a fuller refund. Jewelry and freight pieces follow the no-return list on that page except where the law requires a remedy. We will refuse later orders. We do not run an identity check at checkout. We act on what we actually learn.
The shop and the products
We curate art, décor, jewelry, and furnishings. Handmade and artisan pieces vary in color, texture, size, and finish. Those variations are part of the work, not defects. Colors on a screen will not match a piece in every light. Prices are in U.S. dollars. An order is an offer to buy. We may accept or decline all or part of an order, including after checkout if there was an obvious pricing or stock error. If we cancel after a charge, we refund the payment method.
You may not buy from this site for resale unless we have agreed in writing.
Intellectual property
The site, the photographs, the writing, Rhônya’s artwork, and the Bella Bohemian name and look are owned by us or used with permission. You may view the site and print a page for your own household use. You may not copy, scrape, resell, or build on our content without our written permission.
Links and optional tools
The site may link to other sites or offer tools we do not control (including Shop Pay and Klarna). Their terms and privacy policies apply to what they do. We are not responsible for their content or their mistakes.
Do not send confidential ideas
Other than what you need to place an order or commission artwork through the channels we publish, please do not send confidential business ideas through the site. Anything you send, other than personal data we handle under the Privacy Policy, may be treated as non-confidential.
Orders, payment, and shipping
Pay through checkout on this site. We do not take phone orders, so names and addresses stay accurate. Shop Pay and Klarna may appear as options. HQ pieces (Rhônya’s Art, Jewelry, Gifts → Kitchen & Dining, and Gifts → Stationery, shipped from Virginia) and all other décor or furniture follow different shipping rules. Some décor and furniture leave a supplier warehouse in the United States rather than HQ. Those rules — including contiguous-U.S. limits on warehouse-shipped pieces and freight, and no P.O. boxes — are on the Shipping page. They are part of these Terms. Risk of loss passes according to the carrier’s rules once we hand the goods over, except where the law says otherwise.
Returns
Jewelry is not returnable on a change of mind. If a piece arrives damaged or is not what we shipped, write within three days of delivery with photos; we will replace it or refund it. Wear after it is in your hands is yours. Freight shipments are not returnable on a change of mind except where the law requires. Freight damage is handled with photos, a note on the bill of lading, and replacement parts where the factory will send them. Do not refuse a pallet unless we told you to. Other eligible parcel items follow the Returns page: 14 days from delivery shown on tracking; unused, undamaged, and in original condition in the original packaging; 30% restocking; customer-paid insured return shipping. A sealed box that was crushed on the way back is not original condition. Damage in return transit is on the buyer. Concealed-damage claims on parcels must reach us within 3 days of delivery. Those pages are part of these Terms.
Force majeure
We are not responsible for delay or failure caused by events beyond a small shop’s reasonable control, including carrier failure, weather, strike, supply interruption, platform outage, or government action. File carrier claims for lost or damaged parcels as the Shipping page describes.
Disclaimer and limit of liability
The site is provided as is. To the fullest extent Virginia law allows, we disclaim implied warranties that the law lets a merchant disclaim. We do not exclude any warranty or remedy the law says we cannot exclude, including any non-waivable consumer right.
To the fullest extent the law allows, Bella Bohemian LLC is not liable for indirect, incidental, special, or consequential damages, or lost profits, arising from the site or an order. Our total liability for any claim connected with the site or an order is limited to the amount you paid us for the product at issue. Some states do not allow certain limits; in those states we limit liability to the maximum the law permits.
Indemnity
You will defend and hold harmless Bella Bohemian LLC and its owners from claims, damages, and reasonable legal fees arising from your misuse of the site, your violation of these Terms, or content you submit.
Acceptable use
Use the site lawfully. Do not attack it, scrape it in an abusive way, post what is not yours, or use it to break export or other laws.
Governing law and venue
These Terms and any dispute arising out of the site or an order are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules that would point elsewhere.
You and Bella Bohemian LLC agree that any court action that is not sent to arbitration under the next section will be brought only in the state courts located in Fairfax County, Virginia, or in the United States District Court for the Eastern District of Virginia, Alexandria Division. You consent to those courts.
Individual arbitration
Except for small-claims court in a court that has jurisdiction over you or over us, and except for a request for temporary injunctive relief to protect intellectual property, any dispute arising out of or relating to these Terms, the site, or an order shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration is Fairfax County, Virginia. The arbitrator may award the same individual relief a court could award.
Class arbitrations, class actions, and representative actions are not permitted. You and Bella Bohemian LLC each waive a jury trial and waive participation in a class or representative action to the extent the law allows. If a court finds the class waiver unenforceable as to a particular claim, that claim may proceed in court and the rest remains in arbitration.
Everything else
If a piece of these Terms cannot be enforced, the rest still applies. Our failure to enforce a point once is not a waiver. These Terms, plus the Privacy, Shipping, and Returns pages, are the whole agreement for use of the site and ordinary product orders. Commissioned artwork may have a separate written understanding. We may update these Terms by posting a new version with a new date. Continued use after that date is acceptance. You may not assign these Terms without our written consent.
